with the following terms and conditions

 

 

 

  1. The Client assigns the Agent to perform work out of full-time working hours . The Agent accepts the assignment, based on which he/she undertakes to perform the work and other obligations as defined herein.

 

  1. The Agent shall perform testing at the Institution (employment facility, catering unit, etc.) located at [●]. The Agent participates in the testing as Roma/non Roma testperson.

 

  1. The Agent undertakes to visit the above employment facility/catering unit as potential employee/customer, and shall act as a person seeking employment/potential customer. He/she shall record his/her experiences, observations based on the questionnaire prepared by the Client within one hour from the testing. The Agent undertakes to comply with the further specific requests of the Client regarding the employer/catering manager, and to reply also to further questions on the testing, and of those indicated in the questionnaire.

 

  1. In order to achieve an objective testing, the Agent undertakes to appear at the testing in ordinary street clothing, behave neutrally, to write replies being in accordance with reality, and to answer the Client’s questions to his/her best knowledge.

 

  1. The Agent shall consult the Client as necessary, and shall inform on the issues arisen related to his/her assignment without delay, and shall ask for the opinion of the Client on the eventual steps to be taken.

 

  1. The Client shall compensate for all costs of the Agent arisen in relation with the testing (travel, accommodation, meals, entrance fees).

 

  1. In case the fulfilment of the assignment shall fail due to a reason being in the scope of interest of the Agent, no agency fee shall be payable.

 

8.      The Agent undertakes that in the event a court procedure being launched consequent to the testing with respect to the discrimination tested by him/her, he/she shall – upon the summoning of the court – appear in the procedure as witness, and shall explain his/her experiences in accordance with the truth.

 

9.      The Client undertakes that in the event a court procedure being launched, all costs necessary for the tester’s to appear as witness (travel and incidental costs which are indispensable for and directly connected to appearing as witness), upon request of the tester shall be paid in advance one day prior to travelling, about which the Agent shall issue a receipt, and afterwards shall hand over the invoices.  

 

  1. The Client undertakes not to have the tester involved in such a situation – beyond the testing, but being in relation with that – in which his/her human dignity is infringed or his/her personal safety is endangered. In case such situation arises in direct relation with the testing, then upon request it shall provide legal protection. This legal protection shall cover only the events that may be related to the testing.

 

  1. The Agent undertakes not to disclose information about the testing to third parties, and shall do his/her best to keep the method and the event in secret until the launch of the legal procedure, except the Client giving a special permission to disclose. The Agent shall speak about the event with the Client’s consent even after the legal procedure.

 

  1. The Client undertakes not to disclose the identity of the tester to third parties, except for the project accounting managed by the financing entity as confidential, and the legal procedure related to the testing. Otherwise the Client is bound by the confidentiality rules of the Act on Attorneys.

 

  1. Agency fee

As a countervalue for the daily field-work, after the completion of the task the Client shall transfer a gross amount of HUF [●] to the account  or a postal address designated by the Agent. The Client undertakes that in case to appear as a witness shall become necessary, it shall pay a per diem of HUF [●] to compensate for the loss in income.

 

 

  1. The Agent shall observe the specific ad hoc instructions of the representative of the Client, and to correct them if necessary.

 

The parties have signed this agreement as it being in full accordance with their intentions.
